These Terms of Service (“Terms”) govern your access to and use of the website https://homewatchbyfirefighters.com (the “Website”) operated by Homewatch by Fire Fighters (“we,” “us,” “our,” or the “Company”). We are a firefighter-owned business providing home watch, keyholder, concierge/home management, estate management, handyman, hurricane preparation, pressure washing, window washing, interior cleaning, pool/spa maintenance, landscaping, and related services primarily in premier South Florida communities (including but not limited to Boca Raton, Delray Beach, Jupiter, Palm Beach Gardens, Wellington, West Palm Beach, and surrounding areas).

By accessing, browsing, or using the Website (including submitting quote requests or contact forms), you agree to these Terms. If you do not agree, do not use the Website.

  1. Use of the Website

The Website provides general information about our services and service areas, and includes a form to request quotes or contact us. You may use the Website only for lawful purposes and in compliance with these Terms. You represent that you are at least 18 years old and capable of entering binding agreements.

  1. Services and Quotes
  • All information on the Website is for general informational purposes only and does not constitute a binding offer to provide services.
  • Quotes are estimates provided after an on-site walkthrough or discussion and are subject to change based on actual conditions, scope, or other factors.
  • Actual services are governed solely by separate quotes, invoices, verbal or written agreements, customized flat-fee plans, or service contracts between you and us (collectively, “Service Agreements”). Service Agreements control in case of any conflict with these Terms. We require no long-term contracts; services are provided on a flexible, flat-fee basis customized to your needs.
  • Services include periodic inspections (e.g., weekly), detailed photo and/or video reports emailed to you, immediate alerts for issues (leaks, pests, storm damage, emergencies), vendor coordination, emergency response (24/7 availability), and more. We are licensed, bonded, and fully insured for professional coverage.
  1. Service Disclaimers and Limitations
  • Our home watch, inspections, maintenance, and related services are periodic and not continuous, real-time, or 24/7 monitoring. We do not guarantee prevention of damage, theft, intrusion, loss, or any other issue. Reports identify visible conditions at the time of the visit but do not constitute professional engineering, structural, or warranty inspections.
  • We assist with insurance compliance by providing documentation, reports, photographs and videos, and visit logs (as authorized by you), but we are not insurance providers, brokers, or advisors. Review your insurance policy independently; we are not liable if your insurer denies coverage or claims.
  • We coordinate with licensed professionals for repairs or specialized work, but are not responsible for their actions.
  1. Communications and Consent

By submitting information via the Website or engaging our services, you consent to receive communications electronically (including quotes, reports, alerts, invoices, service updates) via email, SMS/text, phone, or other means.

  • We use Market Central Hub (www.marketcentralhub.com) for forms, SMS/email delivery, and marketing. Your use of these features is also subject to their Terms and Conditions and Privacy Policy.
  • SMS/Text Messages: We comply with the Telephone Consumer Protection Act (TCPA). Service-related messages (e.g., appointment confirmations, emergency alerts, report notifications) may be sent without separate marketing consent. Marketing/promotional texts require your prior express written consent (e.g., via a clear checkbox on forms: “I consent to receive marketing SMS from Homewatch by Fire Fighters at the number provided. Consent is not required to purchase services. Msg & data rates may apply.”).
  • Revoke consent anytime by reasonable means (reply STOP/UNSUBSCRIBE or contact us); we honor promptly (within 3 business days) and may send one confirmation. Reply HELP for assistance. Standard message/data rates apply; frequency varies.
  • Consent is not required to purchase services.
  1. Intellectual Property

All content on the Website (text, images, logos, reports, templates) is owned by us or our licensors and protected by copyright and other laws. You may not copy, modify, distribute, or use commercially without written permission.

  1. Payments and Billing

Payment terms (e.g., upfront, recurring flat fees) are specified in Service Agreements or invoices. We accept common methods (contact us for details). No refunds for partial periods unless agreed. Late payments may incur fees.

  1. Force Majeure

We are not liable for delays, failures, or inability to perform due to events beyond our reasonable control, including acts of God, hurricanes, floods, storms, government actions, emergencies, pandemics, or third-party failures.

  1. Disclaimers

The Website and services are provided “as is” and “as available” without warranties of any kind, express or implied. We disclaim all warranties regarding accuracy, completeness, timeliness, or fitness for a particular purpose.

  1. Limitation of Liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, consequential, special, punitive, or exemplary damages (including lost profits, data, or property loss), even if advised of the possibility. Our total liability for any claim related to services shall not exceed the fees paid by you in the 3 months preceding the claim (or $1,000 if no fees paid), except where prohibited by law (e.g., no limitation for gross negligence causing personal injury or death).

  1. Indemnification

You agree to indemnify, defend, and hold us harmless from claims, losses, or liabilities arising from your violation of these Terms, misuse of the Website, or provision of inaccurate information.

  1. Dispute Resolution

Any disputes shall first be resolved through informal contact. If unresolved, you agree to binding arbitration in Palm Beach County, Florida, under American Arbitration Association rules (or similar), with no class actions. These Terms are governed by Florida law, without regard to conflicts principles. The venue for non-arbitrable matters is in the Palm Beach County courts.

We may terminate or suspend access to the Website or services at any time for any reason.
